What's Inside the Course?
Module 1
The Fundamental Skills
In this module, we cover the fundamental skills that they don’t cover in a paralegal certificate program, but that are critical to a paralegal working in a personal injury firm, including:
- How to be a proactive personal injury paralegal with a shift in mindset
- Mastering time management skills to get you out of the office sooner
- Becoming an expert in client management
- Terms and terminology
Module 2
Mastering the Intake Phase
This is where we start talking about finding the bottleneck that could be preventing PI claim files from getting to the demand and settlement phase and, more importantly, what the personal injury paralegal can do to FIND and FIX the bottleneck. This module covers topics, including:
- Evaluating different intake options and a step-by-step guide to set each of them up
- The critical tasks before the client meeting
- Your important role at the client meeting
- How to evaluate the intake data to see if there are bottlenecks to fix
Module 3
Gathering the Evidence
It’s time to start collecting the records, which is a place where the most bottlenecks occur, so we give them the skills and tools to be:
- Sending medical records requests
- Tracking the subrogations and liens
- Getting the photographs (or how to outsource if it)
- Conducting witness interviews – along with a mock witness interview for you to learn from
- Gathering other records that are typical in a personal injury claim file
Module 4
Managing the Medical Records
Now that the medical records are coming in, we take a deep dive into managing them efficiently and proactively. Some of the topics covered in this module include:
- Paralegal case management tools
- Managing the medical records to keep the case moving forward
- Preparing medical summaries and chronologies
- Medical status updates to keep the client active in their treatment
- Tracking medical expenses throughout the pre-litigation phase of the personal injury claim
Module 5
The Demand Package and Settlement Negotiations
All of the prior modules lead to this goal – find and fix the bottlenecks to get to the demand package and settlement phase sooner. In this module, we cover:
- The importance of a complete demand package
- Drafting the demand letter using your personal injury checklist for paralegals
- Proofreading techniques to reduce errors in the demand letter
- How to tell the client’s story for a thorough demand package
- Negotiations to get the file to the settlement phase
- Your important role during the disbursements phase and things you want to look out for
Module 6
Starting Litigation
If the personal injury claim file doesn’t settle after the demand package (or if the SOL is running out), then the personal injury paralegal needs to know how to initiate litigation.
In this module, we provide a plan for initiating litigation, including a litigation checklist, but if you want your paralegals to have a deeper understanding of the entire litigation process from the complaint through the trial, consider enrolling them in our Litigation Paralegal Boot Camp. We don’t cover all of those steps in this course because many personal injury law firms have separate pre-litigation and litigation departments.
